These Terms explain your rights and responsibilities when using StudyVCE, including our website, apps, learning resources and AI features. Please read them before creating an account or making a purchase.
1. Who we are
StudyVCE is operated by Intelligence Education Technology Pty Ltd in Victoria, Australia. In these Terms, “StudyVCE”, “we”, “us” and “our” mean that company.
You can contact us at hello@studyvce.net or through our contact page.
StudyVCE is an independent learning platform. Neither StudyVCE nor its resources or services are affiliated with, approved, endorsed or sponsored by the Victorian Curriculum and Assessment Authority (VCAA). References to VCE subjects and assessments identify the learning context of our resources and do not imply an official relationship.
2. Accepting these Terms
You agree to these Terms when you accept them during registration or checkout. If you purchase a service, the plan and offer details presented before you confirm your order also form part of your agreement with us. Those specific details govern the price, billing period and included features for that purchase.
Our Privacy Policy explains how we handle personal information. Accepting these Terms does not, by itself, give consent to optional marketing, model training or any other processing that requires separate consent.
Nothing in these Terms removes rights that applicable law does not allow us to exclude or limit.
3. Age and accounts
You must be at least 13 to create an account or use features that ask you to provide personal information. A higher minimum age or additional parental consent may apply where you live.
If you are under 18, review these Terms with a parent or guardian. Where the law requires their permission, obtain it before using the relevant service. A parent or guardian must make any purchase that you are not legally able to make yourself. We do not treat a child's acceptance of these Terms as automatically binding their parent or guardian.
Provide accurate account information, keep your sign-in credentials secure and contact us promptly if you suspect unauthorised access. Your account is for your own use unless we expressly provide a shared or institutional arrangement. You are not automatically responsible for unauthorised activity that you did not cause or could not reasonably prevent.
4. Learning resources and AI features
StudyVCE provides learning resources and study support. Available subjects, resource types and features are described on the relevant pages and, for paid services, in the offer you purchase.
AI features, including automated writing feedback, generate responses using artificial intelligence. Responses may contain mistakes, omit relevant information or produce inaccurate citations. Check important information against your current course materials and your teacher's guidance.
Automated feedback is not a human examiner's review or an official VCE assessment. If a service includes human review, we will identify that service and explain the reviewer's role before you use or purchase it. A human contributor's involvement does not imply VCAA endorsement.
We do not promise a particular grade, admission outcome or examination result. Your teachers, school and relevant examining body determine your official assessments. These limitations do not reduce our responsibility to supply services with the care and skill required by law or to honour the features and descriptions we sell.
5. Academic integrity and responsible use
Use StudyVCE in accordance with your school's rules and the requirements for your particular task. Permission to use AI and the requirement to acknowledge it are separate questions. A citation does not make an otherwise prohibited use acceptable.
You must not use StudyVCE to:
- submit another person's work or AI-generated work as your own;
- produce fabricated research, data, references or records for assessment;
- obtain or distribute leaked or confidential assessment materials;
- impersonate another person, misrepresent qualifications or deceive others;
- upload material you are not entitled to use, or unnecessarily disclose another person's personal information;
- harass others, distribute unlawful content or compromise anyone's safety;
- bypass security or usage controls, access another person's account, or disrupt the service; or
- systematically copy, scrape, resell or redistribute our resources without permission, except where applicable law permits the activity.
Keep your own thinking and authorship central to assessed work. Our academic integrity guidance provides further information.
6. Free access, subscriptions and usage limits
Some resources are available free of charge. Paid plans provide the additional features described in the offer presented to you. A paid plan does not mean that every resource on StudyVCE is exclusive to subscribers.
Before you confirm a purchase, we will show the price and currency, applicable taxes and charges, billing interval, included features, and any material usage limits. If a feature uses credits, we will explain the included allowance, how credits are used, when they refresh or expire, and what happens when the allowance is exhausted.
We will not impose undisclosed material limits on a feature sold as unlimited. Reasonable controls to prevent automated abuse or protect security must not be used to withdraw the ordinary use included in your plan.
Where an offer includes live sessions or human support, the offer will state the relevant availability, booking arrangements and limits. Do not assume that AI feedback includes a live teacher or examiner.
7. Trials, billing and renewal
Where a subscription renews automatically, we will make that clear before purchase. You authorise the recurring charges disclosed at checkout until you cancel. We will provide an order confirmation or receipt identifying your subscription and charges.
If you start a free or discounted trial, we will show its duration, the date and amount of the first subsequent charge, the renewal interval, and how to cancel before that charge. A trial does not require a paid commitment beyond the terms you expressly accept.
For subscriptions purchased directly from StudyVCE, payments are processed through the payment provider identified at checkout. If you purchase through an app store or another authorised seller, its payment and cancellation process may apply. This does not remove rights you have against StudyVCE under applicable law.
If a payment fails, we may ask you to update your payment method. We will give you a reasonable opportunity to resolve the problem before restricting paid access, unless there is a reasonable fraud or security concern. We will not charge a different price or add a new paid product without the required notice or authorisation.
8. Cancelling a subscription
To cancel a subscription purchased directly from StudyVCE, email hello@studyvce.net from your account email address. You can also use account billing controls where available. A technical failure will not remove your right to cancel.
Cancel before the next scheduled charge to prevent renewal. A valid cancellation request received before that charge will be treated as made when we receive it, even if we process it later. We may ask for information reasonably necessary to verify the account.
Unless the offer provides otherwise, you retain paid access until the end of the period already paid for. If you cancel a free trial before the first charge, no subscription payment is due and trial access ends on the date stated in the offer. We will confirm your cancellation and the date access changes.
Cancelling a subscription does not automatically delete your account or learning history. Uninstalling an app or stopping use does not, by itself, cancel a subscription. Contact us if you want both cancellation and account deletion.
9. Refunds and consumer rights
You have rights under applicable consumer law, including the Australian Consumer Law where it applies. Those rights may include a remedy if services are faulty, are not supplied with due care and skill, or do not match their description. Depending on the circumstances, you may be entitled to correction, cancellation, a refund or compensation.
Nothing in these Terms requires you to give up those rights. Any refund promise made in your offer also applies.
Outside your statutory rights and any refund promise, cancelling because you have changed your mind normally stops future renewal and does not create an automatic entitlement to a refund for a period already started. You may still contact us about an accidental charge, billing error or exceptional circumstances, and we will consider the facts fairly.
If we discontinue a paid service or end your access for reasons unrelated to your breach, we will refund the unused prepaid portion of the affected service. Where the law requires a different or greater remedy, that remedy applies. Suspension or termination for a breach does not automatically forfeit any statutory refund entitlement.
To request a refund, email your account email address, the relevant transaction and a brief explanation to hello@studyvce.net. Do not send full payment-card details.
If you are a consumer in the European Economic Area, the United Kingdom or another place with a statutory withdrawal or cooling-off right, that right applies where required by local law. Starting a service or accessing digital content removes such a right only where the applicable legal conditions are met, including any required separate request, express consent and acknowledgement. Accepting these general Terms alone does not waive it.
10. Changes to prices and services
We may improve, update or replace features. We will not materially reduce the paid service you have already purchased during its prepaid period without your agreement or an appropriate cancellation and refund option.
For a subscription price increase, we will give reasonable advance notice and meet any minimum notice period required by law. The increase will apply no earlier than the renewal identified in the notice. You can cancel before that renewal without an additional cancellation fee. Where the law requires express agreement to a change, we will obtain it.
Free features may change or be discontinued. Where a change will materially affect saved work or access, we will give reasonable notice and an opportunity to retrieve information where practicable. Urgent security or legal requirements may require shorter notice.
11. Your content
You retain the rights you hold in work, messages and other material you submit. You must have the rights or other lawful authority needed for the particular material and use. These Terms do not transfer ownership of your work to StudyVCE.
You give us a non-exclusive, royalty-free licence to host, copy, transmit and technically process your content only as reasonably necessary to provide the features you request, maintain the service, and address security, support or legal requirements. For example, generating feedback may require sending your submission to a contracted AI provider. Service providers may process the material only within the scope needed for those purposes and the permissions described in our Privacy Policy.
This licence does not authorise us to publish your private work, sell it as a resource, use it in advertising, or train or fine-tune AI models on it. Any proposed optional use beyond the service purposes above requires a separate explanation and appropriate permission. Refusing an optional use does not remove your access to the service you purchased.
The licence ends when your content is deleted, except to the limited extent needed to meet legal obligations or resolve an existing dispute. It does not override your personal-information rights.
You also retain any rights you hold in your contributions to AI-assisted work. We cannot promise that AI output is unique, free of third-party rights or eligible for copyright protection.
12. Our resources and third-party materials
StudyVCE resources may be owned by us or used under rights held by other people. Subject to the access rights for your plan, you may view and use the resources for your personal learning and make downloads where we provide that functionality.
You may not republish, resell or commercially distribute resources without the relevant permission, unless applicable law permits it. Third-party materials remain subject to their owners' rights. Nothing in these Terms claims ownership of VCE materials or grants you rights that StudyVCE does not hold.
If you believe material on StudyVCE infringes your rights, contact hello@studyvce.net with the relevant page or file, the work concerned, your relationship to the rights holder and enough information for us to investigate. We may temporarily restrict disputed material while reviewing the issue.
13. External services and links
StudyVCE may link to external sites or offer sign-in, payment or community features through other providers. Those providers may have their own terms and privacy notices. Check them before sharing information or making a separate purchase.
A link does not guarantee that an external site's material is accurate or licensed for your intended use. This section does not exclude responsibility that the law places on StudyVCE for our own recommendations, representations or service providers.
14. Suspension and termination
We may restrict or end access where there is a reasonable basis to believe that you have materially breached these Terms, failed to pay an amount properly due, created a serious security or safety risk, or used the service unlawfully. Restrictions will be proportionate to the issue.
Where reasonably possible, we will explain the reason, give notice and allow you a reasonable opportunity to correct the problem. Immediate action may be necessary for a serious or continuing risk, or where the law requires it. We may withhold specific details if disclosure would compromise security, another person's rights or a legal investigation.
You can ask us to review a decision by emailing hello@studyvce.net. We will consider relevant information and correct mistakes. Refund rights are addressed in section 9.
You may stop using StudyVCE at any time and request account deletion under our Privacy Policy. If you have a paid subscription, use the cancellation process as well or tell us expressly that you want it cancelled. We will explain any steps needed for a purchase managed by another seller.
15. Our responsibility to you
We will provide the service with the care and skill required by applicable law. We are responsible for loss caused by our breach of these Terms or our failure to meet applicable legal duties to the extent the law provides.
To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable as a result of our breach. We are not responsible for a particular academic outcome merely because you used StudyVCE. This does not exclude responsibility where our own breach causes loss for which the law provides a remedy.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, a non-excludable consumer guarantee, or any other liability that cannot lawfully be excluded or limited.
16. Complaints and governing law
Please contact us if something has gone wrong. We will review your complaint and try to resolve it fairly. You do not have to complete our complaint process before exercising a right to approach a regulator, tribunal or court.
These Terms are governed by the laws of Victoria, Australia. If mandatory consumer protections in your place of residence apply, you keep those protections. The courts and tribunals of Victoria have non-exclusive jurisdiction, without removing any right you have to bring a claim in another competent forum, including where you live.
These Terms do not require compulsory private arbitration or prevent you from taking part in a proceeding where the law permits it.
17. Updates to these Terms
We will publish the current version and its date on this page. For a material change affecting an existing account or subscription, we will give reasonable advance notice by email or an appropriate in-product notice explaining the change and when it takes effect. Price changes are subject to section 10.
We will give you an opportunity to stop using the affected service, and to cancel with an appropriate refund of unused prepaid access where a material adverse change affects that access. We will obtain renewed agreement where required by law. We will not treat silence or continued use as consent to a new optional personal-data use.
Changes will not retrospectively remove rights that have already arisen. Urgent changes required by law or necessary to address a serious security risk may take effect sooner, with notice as soon as reasonably practicable.
If a provision cannot be enforced, the remaining provisions continue to apply so far as the law permits. A delay in enforcing a right does not, by itself, waive that right.
